Terms and Conditions of Service

1. Definitions

ChatLPO or the Platform: Refers to the website https://chatlpo.com and all associated services.
User or You: Is the person who accesses or uses the Platform.
User Content: Refers to any text, data, file, message, or other material that the User sends or posts on the Platform.

2. Acceptance of Terms

By using or accessing ChatLPO, the User accepts the Terms and Conditions, as well as the platform’s Privacy Policy. If you do not agree, the User should not use the Platform.

3. Service Description

ChatLPO is a chat platform with artificial intelligence to support teachers. ChatLPO reserves the right to modify, suspend, or discontinue the platform or any of its functionalities, including prices and usage limits, with or without prior notice. It may also delay or deny access to the Platform for maintenance, security, or force majeure reasons.

4. Privacy, confidentiality, and information protection policies

The User is obligated to maintain the confidentiality of data provided by other Users.
The User is responsible for the use and custody of their Username and Password, which are for exclusive, personal, and non-transferable use. Therefore, ChatLPO is not responsible for damages caused by their misuse by third parties.
If the User detects improper use of their Username or Password, they must immediately notify ChatLPO through the provided contact channels.

5. Verifications

ChatLPO reserves the right to verify information provided by the User. If the information is found to be untrue, ChatLPO may deactivate the User’s account and deny access to the Platform.
ChatLPO may request a form of identification or subject Users to background checks to confirm their identity. It may also filter Users by comparing their data with third-party databases and other public or private sources.
ChatLPO and affected Users may take legal action against Users who have provided false information.

6. Intellectual Property

6.1. Protected Content

All Platform material, such as texts, data, designs, logos, trademarks, graphics, photos, and software, is considered protected content.

6.2. Trademarks

The ChatLPO trademark, its logos, trade names, and the domain www.chatlpo.com are the exclusive property of ChatLPO.

6.3. Prohibitions

Platform Content may not be copied, modified, reproduced, reused, or redistributed by the User without prior written authorization from ChatLPO.
The User may only access, download, transmit, and print the Content for personal use and within the framework of the services ChatLPO offers.
Modifying or creating derivative works from Platform Content is prohibited.
The User may not use ChatLPO Content on other sites, including creating links, without prior written authorization.
Creating a “mirror” site of the ChatLPO Platform or publishing it on other servers or on the internet is not permitted.

6.4. Consequences of Unauthorized Use

Any unauthorized use of the Content constitutes a violation of copyright and intellectual property laws, and may result in deactivation of the User’s account, termination of the usage agreement, and denial of access to the Platform. ChatLPO also reserves the right to take legal action, both civil and criminal.

7. Use of the Site and its Content

The User agrees to use the Content and Platform legally and in accordance with the terms and conditions of the agreement. ChatLPO does not guarantee that the Contents and Services are appropriate for use outside of Chile; if a User accesses from abroad, they are responsible for complying with the laws of their jurisdiction.

8. Registration and Account

To access certain features, the User must create an account and provide accurate and up-to-date information.
The User is responsible for the confidentiality of their password and all activities performed with their account.
It is mandatory to notify ChatLPO immediately if unauthorized use of the account is detected.
ChatLPO may suspend or cancel accounts that have been inactive for more than 12 months or upon suspicion of fraud.

9. Acceptable Use

It is prohibited to post, upload, or distribute content that is illegal, defamatory, obscene, or that infringes on the rights of third parties.
Using the Platform to send spam, malware, or perform reverse engineering, or to compromise security or attempt to extract source code is not permitted.
ChatLPO reserves the right to remove any User Content that does not comply with these standards and to suspend or cancel accounts.

10. Limitation of Liability

The Platform is offered “as is” and “as available”, without warranties of any kind.
ChatLPO is not responsible for direct, indirect, incidental, special, punitive, or consequential damages.
The User is responsible for verifying the accuracy of Content provided by artificial intelligence and for assuming the consequences of its use.
ChatLPO’s total liability will not exceed the amount paid by the User in the six months prior to a claim.

11. Use of Cookies

ChatLPO uses session and persistent cookies to maintain authentication, improve navigation, security, and analyze Platform usage.
Cookie information is stored encrypted and does not contain personally identifiable data.
Disabling cookies in the browser will prevent access to authentication and personalization functionalities.

12. Service Availability and Continuity

The Platform may be temporarily unavailable due to maintenance, technical failures, or force majeure. ChatLPO will strive to restore the service, but will not be obligated to offer any compensation.

13. Suspension and Termination

ChatLPO may suspend or cancel an account if the User violates these Terms, engages in fraudulent or illegal activities, or provides false information. Upon termination, the User will lose access to the Platform and their User Content without the right to a refund of fees paid, unless the law provides otherwise.

14. Force Majeure

ChatLPO will not be responsible for failure to fulfill its obligations if it is due to causes beyond its reasonable control, such as natural disasters or power outages.

15. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Republic of Chile. Any dispute will be resolved in the courts of Santiago, Chile.

16. Modifications to the Terms

ChatLPO may modify these Terms at any time, and the date of the last revision will be published.
Continued use of the Platform after publication of changes implies acceptance of them.
In case of substantial changes, the User will be notified in advance and given the option to cancel their subscription.
